1. Agreement: I must pay CARdiacs the full amount on the date I entered into this Agreement and CARdiacs agrees to provide the Event on the terms and conditions of this Agreement.

2. Event: The Event consists of CARdiacs providing:
   – the Experience to one or more Participants 
   – other ancillary items necessary for participating in the event or participating as a spectator.

3. Risks: I acknowledge that the event is an inherently dangerous recreational activity and that I and any other Participants will be exposed to certain risks.

4. Instructions and conduct: CARdiacs may give instructions or directions to me and the Participants. I will follow CARdiacs instructions and directions and, at all times during the Event, I will ensure that I or we will
   – follow CARdiacs instructions and directions;
   – behave in an appropriate and ethical manner; and
   – demonstrate respect for the other people in attendance, for CARdiacs staff and for the property of others.

5. Stoppage, removal and non-participation I acknowledge that:
   – CARdiacs may end any Experience where conditions have, in its sole opinion, become unsafe whether due to the state of a Vehicle or the track, the weather or any other reason; and
   – CARdiacs may remove any Participant from the Experience or from its premises for safety reasons or for failure to behave appropriately or follow instructions.

6. No entitlement to refund: I acknowledge that if the Event is ended early, or one or more Participants are removed from the Experience or the premises or otherwise not allowed to participate, I will not be entitled to any refund or reduction in the Fees. If the event is ended early for reasons that are not related to the behaviour of any Participant (such as for unsafe  weather conditions) then CARdiacs will use reasonable endeavours to reschedule the Event.

7. Property: CARdiacs is not responsible for my, or any Participant’s personal property during the Event.

8. Images: CArdiacs may take photos, videos, audio and other recordings or images of me, the Participants and any Organiser Vehicles in connection with my participation in the Event (Images). CARdiacs:
   – owns all such Images; and
   – may use or reproduce any Images to promote CARdiacs and its activities (including on the CARdiacs website and social media).

9. Cancellation by me: I acknowledge that, if I cancel the event on less than 5 days notice to CARdiacs, CARdiacs may claim, and I must pay the following cancellation fee:
   – any amounts paid or payable by CARdiacs for the track, catering or other supplies or equipment; and
   – in respect of CARdiacs entry fee
   CARdiacs may use any part of the Fees paid by me to cover the above amounts, the above costs may be waived  (wholly or partially) by CARdiacs in its absolute discretion.

10. Cancellation by CARdiacs: CARdiacs may cancel the Event for any reason and will endeavour to give me as much notice as is possible of such cancellation. CARdiacs will refund any Fees that have been paid, with such refund to be paid within 30 days of such cancellation.

11. Release and indemnity: To the extent permitted by law, I release and indemnify CARdiacs, the Owner, and their respective directors, servants, officials, employees, contractors,  representatives, agents, related parties and other participants in, and spectators, from all claims which may be made by me or on my behalf, in respect of or arising  out of any liability or loss (including but not limited to damage to property, injury or death) that I or any Participant suffers during the course of, or as a result of my organisation and invitation of the Participants, or any Participant’s participation in , and however caused, including due to the negligence of or omission of CARdiacs or its Associates.

12. Insurance: I acknowledge that I am responsible for my own insurance.

13. Disputes: Before resorting to external dispute resolution mechanisms, the parties must in good faith attempt to settle by negotiation any dispute in relation to this Agreement, and where practical,  each party must refer the matter to personnel who have authority to intervene and facilitate some form of resolution.

MISCELLANEOUS

 

These Terms of Use and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. These Terms of Use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms of Use or use of the Site. You agree that these Terms of Use will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Terms of Use and the lack of signing by the parties hereto to execute these Terms of Use.

 

 

EVENT RULES:

​

Helmets required, Passengers require helmets, No doughnuts, No burnouts, Do not enter the airstrip without the gate keepers approval, Do not start the race without the gate keepers approval, After your run exit off the airstrip immediately, NO DRINKING AND DRIVING.

 SPECTATOR RULES:

 

No standing beyond the red tape, No gazebo’s beyond the red tape, No braai's or open fires within the airstrip area (there are dedicated braai areas at the facility), Spectator vehicles must be parked in the designated area, No selling of food or drinks permitted, Should the rules above not be adhered to, participants agree to be liable for any fines brought forward from the facility where the event is held. You agree to all photos and video related content containing but not limited to cars and spectators to be posted on social media under the CARdiacs brand.
